Terms and Conditions of Use for Publineo

§1 Definitions

Publineo / Application — the SaaS platform available at publineo.com, app.publineo.com, and related subdomains.
ITAMA / Operator — F. H. U. ITAMA Dariusz Niemczak (sole proprietorship, NIP: 9581479203, REGON: 222025985, ul. Starowiejska 16/2, 81-356 Gdynia). Contact: support@publineo.com.
User — a natural or legal person who has an account in the Application.
Organization — the brand / company on whose behalf the User creates and publishes content.
Channel — an external platform (Facebook, Instagram, WordPress, LinkedIn) connected by the User.
Plan — a service package (Free, Standard, Pro) with a defined monthly post limit.

§2 What Publineo offers

Publineo is a tool for generating and publishing social media content using artificial intelligence. The Application:

generates post and image content based on the brand profile and topic provided by the User,
enables editing, approval, and rejection of generated content,
publishes approved posts on channels connected by the User.

§3 Account creation

Creating an account requires providing a valid email address and setting a password. In registration mode with approval ("admin approval"), the account is activated after acceptance by an ITAMA administrator.

The User guarantees that the data provided during registration is true and up to date. The account is personal — login credentials must not be shared with third parties. We recommend enabling two-factor authentication (2FA) in the settings.

§4 Plans and payments

Publineo offers three subscription plans:

Free — a free starter plan with a monthly post limit.
Standard — an expanded plan with a higher post limit, billed monthly.
Pro — a plan with the highest post limit for users with substantial needs.

Current gross prices (in Polish zloty) and specific monthly limits are available on publineo.com and in the application when selecting or changing a package. Prices are expressed in PLN and include VAT.

Limits reset on the first day of each calendar month. Unused posts do not carry over to the next month. Payments are charged in advance. We issue invoices automatically and send them by email.

A subscription may be cancelled at any time from within the Application or by contacting support@publineo.com. The subscription remains active until the end of the paid billing period.

§5 What is allowed and what is not

By using Publineo, you agree NOT to:

publish content that violates the law (defamation, fraud, incitement to hatred, pornographic content, intellectual property infringement, etc.),
generate content that misleads recipients as to the identity of the author or the nature of the product,
circumvent Plan limits, for example by creating multiple accounts for the same organization,
use the Application to send spam or automated content outside the scope of normal use,
attempt to break security measures, scan for vulnerabilities, or attack infrastructure,
resell access to the Application to third parties without our consent.

ITAMA may suspend or delete the account of a User who violates these Terms and Conditions, while preserving the right to a refund of the unused part of the fee (pro rata for the period) — unless the violation consists of intentional fraud.

§6 AI-generated content

Publineo uses language and generative models (including OpenAI). The User:

receives full rights to the generated content to the extent permitted by the model provider (OpenAI Terms of Use grant commercial output rights to the end user),
is responsible for reviewing and approving content before publication,
acknowledges that AI may generate incorrect, inaccurate, or outdated information — the Operator is not liable for the consequences of publishing unverified content.

§7 External channels (Facebook, Instagram, WordPress, LinkedIn)

Publishing posts on an external channel requires the User to connect that channel via OAuth or shared tokens. Use of each channel is subject to that channel’s terms (Meta, WordPress, LinkedIn). The Operator is not responsible for:

blocks, restrictions, or API changes of external channels,
content removed by external channels (e.g. violation of Facebook community standards),
publication delays resulting from the limitations of those channels.

§8 Availability and technical breaks

The Operator makes every effort to keep the Application continuously available, but does not guarantee 100% uptime. Planned technical breaks are announced in advance, and failures are fixed as quickly as possible. The duration of a failure does not extend the Plan period unless the total downtime exceeds 24 hours in a month — in that case, we refund a proportional part of the fee upon request.

§9 Liability

The Operator is liable only up to the amount of fees paid by the User in the last 12 months. The Operator is not liable for lost profits, indirect costs, damages resulting from the publication of AI-generated content, or actions of external channels.

§10 Complaints

Complaints should be submitted to support@publineo.com. We review them within 14 days. Consumers have the right to out-of-court dispute resolution (uokik.gov.pl).

§11 Changes to the Terms and Conditions

The Operator may amend these Terms and Conditions with 14 days’ notice. We notify Users by email at the address provided during registration. Lack of acceptance of the changes entitles the User to terminate the agreement free of charge with a proportional refund of the unused part of the fee.

§12 Governing law and jurisdiction

These Terms and Conditions are governed by Polish law. Disputes are resolved by the court competent for ITAMA’s registered office, subject to consumer protection provisions applicable in favor of a User who is a consumer.
